Welcome to RiverHart.Art (the “Site”), operated by River Hart (“we,” “us,” or “our”). By accessing this Site, submitting a commission inquiry, or purchasing artwork, you agree to be bound by the following Terms and Conditions. If you do not agree, please do not use the Site.
Use of the Site
The Site is intended to present and facilitate engagement with original artwork and related services. You agree to use the Site lawfully and in a manner that does not infringe upon the rights of the artist or others.
We reserve the right to modify, suspend, or discontinue any aspect of the Site at any time without notice.
Intellectual Property & Copyright
All artwork, images, text, and materials presented on the Site are the exclusive property of River Hart and are protected under United States and international copyright laws.
The purchase of artwork or a commissioned piece does not transfer copyright or intellectual property rights. Unless explicitly agreed to in writing, River Hart retains all rights to:
Reproduce the artwork
Display the artwork publicly or privately
Use the artwork for portfolio, exhibition, publication, and promotional purposes
License the artwork
Collectors may not reproduce, distribute, alter, or commercially exploit the artwork without prior written consent.
Commission Inquiries & Acceptance
Submission of a commission request constitutes an inquiry only and does not guarantee acceptance.
We reserve the sole and absolute right to:
Accept or decline commission requests
Determine creative scope, medium, scale, timeline, and pricing
No commission is considered accepted until confirmed in writing.
Commission Process
Artistic Discretion
By commissioning an original artwork, you acknowledge that you are engaging River Hart for their unique artistic voice and creative interpretation. While general themes or preferences may be discussed, final artistic decisions remain with the artist.
Deposits
A non-refundable deposit of 50% of the total commission fee is required to secure a commission and initiate work. Work will not begin until the deposit has been received.
Revisions
Minor adjustments may be accommodated at the artist’s discretion. Substantial changes to the original scope, concept, or scale may result in additional fees or require a new agreement.
Completion & Final Payment
The remaining balance is due upon completion and prior to delivery or shipment of the artwork.
Pricing & Payments
All prices are listed in USD unless otherwise stated. Prices are subject to change.
Payments are processed through secure third-party payment providers. We do not store or have access to full payment information.
Sales & Availability
All artwork is offered subject to availability. We reserve the right to refuse or cancel orders at our discretion, including in cases of pricing errors or suspected misuse.
Shipping, Returns & Refunds
Due to the bespoke nature of commissioned and original artwork:
All sales are final
Refunds, returns, or exchanges are not offered once work has commenced or a piece has shipped
In the event that artwork arrives damaged, you must notify us within [7] days of delivery and provide photographic documentation. Any resolution will be handled on a case-by-case basis.
Exhibition & Promotion Rights
Unless otherwise agreed in writing, River Hart retains the right to photograph and display commissioned works for:
Portfolio use
Website and social media
Exhibitions, publications, and press
Collector identity and private details will not be disclosed without consent.
Accuracy of Information
While we strive to ensure accuracy, the Site may occasionally contain errors or omissions regarding descriptions, pricing, or availability. We reserve the right to correct such errors at any time.
Third-Party Links
The Site may contain links to third-party websites. We are not responsible for the content, policies, or practices of those sites.
Limitation of Liability
To the fullest extent permitted by law, [Your Name / Studio Name] shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Site, commission inquiries, or purchase of artwork.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

We reserve the right to update these Terms and Conditions at any time. Any changes will be effective immediately upon posting to the Site.
